Service Order
for the "Newsletter Manager" Service of Register.it SPA
This Service Order ("SO") is an integral and essential part of the General Conditions of Service ("GCS"). The GCS and this SO establish the terms and conditions for supply of the Newsletter Manager Service ("NL Manager Service") by Register.it to the Customer.
The terms with an initial capital letter used in this SO have the same meaning as defined in the GCS.
1 - Description and characteristics of the NL Manager Service
IThe NL Manager Service consists in provision by Register.it to the Customer of a service over the Web for the transmission of e-mail messages to a list of members to the Customer’s site (e.g. containing information, update of site content, advertising, etc). The NL Manager Service that is in addition to a previously existing Domain registered with Register.it includes the following possibilities:
- PWeb based control panel (no download required)
- Management of member list, deletions and additions, download of lists, formatting of texts.
- 12,000 transmissions (for the term of one calendar year)
- Manual subscribe/unsubscribe
- No limit on the number of members, restricted only to the acquired transmissions
The Newsletter Manager control panel contains instructions for the Customer on how to use the form to be entered directly on his Web pages. Using this form, visitors to the Customer’s site can register and receive messages.
The information will be saved, managed, and filed in a specific Web space dedicated to the Customer. The service is provided on a subscription basis to the Customer upon payment of the consideration.
2 - Conditions of the NL Manager Service
Register.it will provide the Customer with the personal access codes so that he can use the service. The use of these codes is regulated in the General Conditions of Service. The NL Manager Service is provided by Register.it only and exclusively in connection with Customer Domain Names maintained by Register.it as Maintainer, Register, or Reseller.
The Customer undertakes not to use the Service for illegal purposes and not to violate any applicable national or international norm or regulation in any way. The Customer also undertakes to respect the Netiquette rules available at the address http://www.nic.it/NA/netiquette.txt
In particular, the Customer guarantees that he will not directly and/or indirectly perform spamming, that is, the transmission via e-mail of communications that are not authorized, not requested, and/or not solicited by the recipients. Register.it notes that this practice is prohibited not only by Netiquette rules but also by Legislative Decree no. 196/2003 in protection of privacy. Furthermore, Register.it emphasizes that it will hold the Customer liable even if the illegal spamming activity is carried out by means of e-mail addresses other than those acquired from Register.it and involves a Register.it Service even indirectly, or directly involves the technical structure of Register.it.
Register.it reserves the right to suspend the Service immediately if, at its own discretion or following a report by others, it believes that the Customer carries out activities through the Service in violation of the obligations envisaged in this article. In this case, the Customer, following notification via e-mail or otherwise by Register.it, must immediately eliminate the causes of the complaint or provide adequate documentation proving full respect of the applicable norms governing the activity performed by him. If he fails to respond immediately, Register.it will have the right to cancel the agreement immediately, without prejudice to the right to full payment of the consideration and the right of Register.it to take action for full indemnification of any damages suffered.
3 - Liability of Register.it
Service activation requests will be active 48 working hours after the request. Register.it will not be liable for any interruptions in service caused by third parties. Furthermore, it may interrupt provision of the service at any time for justified security reasons and/or to guarantee confidentiality, notifying the Customer in this case.
Register.it cannot be held liable in any case for malfunction of the Service depending on events outside the reasonable control of Register.it, such as, for example: (i) events of force majeure; (ii) events depending on the actions of others, such as interruption or malfunction of the services provided by telecommunication and/or electric power line operators; (iii) malfunction of the terminals or other communication systems used by the Customer.
4 - Complaints
The Customer is required to communicate any service irregularities attributable to Register.it through his own control panel within 48 hours after the occurrence thereof. Failure to file a report pursuant to the foregoing terms releases Register.it from all liability.
5 - Data
TAll the data, information, and content sent by the Customer from or through the Service are and shall remain the exclusive property of the Customer. Consequently, the Customer assumes any and all responsibility for such data and their content.
6 - Term
This SO and consequently provision of the NL Manager Service expire one year after acceptance of the agreement. On the expiration date, the Customer may acquire a new package at the terms and conditions envisaged at the time of purchase. If not acquired, the service will be deactivated by Register.it without any prior communication, and any e-mails remaining unused will be lost, with Register.it being released from all responsibility in this regard.
7 - Consideration and Payments
The Consideration for provision of the NL Manager Service is that indicated in the appended offer. All Consideration is agreed to be considered exclusive of V.A.T.
Payment of the consideration for the NL Manager Service must be made by credit card, by filling out the payment form during the registration procedure.
